Freight Handling Terms and Conditions

Payment terms

Payment terms for services rendered will either be, “prepaid”, “due on receipt of invoice”, or net 30 days depending on your pre-negotiated business relationship with JPS Enterprises Ltd. Freight services will require to be prepaid for new accounts in order to establish payment terms. Overdue invoices may be subject to collections notices and/or not limited 2% interest per month after 30 days.

Freight claims

Successful freight claims depend on following proper protocol for the carrier transporting your freight. In most cases those protocols are standard in the industry and are as follows:

  1. The freight must be inspected upon receiving and the bill of lading must be signed off on the bill of lading as “damaged” or “lost/missing”. Digital picture are very helpful.
  2. Time: damage claims must be reported within 30 days after receiving the shipment. Loss claims must be reported within 90 days of receiving the goods.
  3. Original invoice. the original freight invoice must be paid by the customer making the claim. Failure to do this will negate your claim.
  4. Letter of intent and invoice. The customer filing the claim must provide to the carrier a letter of intent to claim (ie email) and provide an invoice detailing the cost of their damages/loss. The cost must be the “landed” cost and not the “retail cost” to the end user.
  5. Concealed damage. This is reported damage that is not visible to the outer carton, crate or other packaging. If damage is present, the receiver must keep the packaging on hand for inspection by an agent of the carrier.
  6. Limited liability. Limited liability for all carriers is $2/lb, this is your declared value without purchasing additional cargo insurance.

Termination
We may terminate or suspend access to our Service immediately, without
prior notice or liability, for any reason whatsoever, including without limitation if
you breach the Terms.


All provisions of the Terms which by their nature should survive termination
shall survive termination, including, without limitation, ownership provisions,
warranty disclaimers, indemnity and limitations of liability.


Changes
We reserve the right, at our sole discretion, to modify or replace these Terms
at any time. If a revision is material we will try to provide at least 30 days’
notice prior to any new terms taking effect. What constitutes a material change
will be determined at our sole discretion.
